Regulation and entry into force
The General Terms and Conditions (GTC) govern the legal relationship between the customer and Bivio Sports Facilities AG and Swiss Ski School Bivio Snowsports.
The contract between the customer and the company Bivio Sports Facilities AG is concluded with the unconditional acceptance of the booking/purchase. From this point in time, the rights and obligations arising from the contract (including these GTC) become effective for the customer and for Bivio Sports Facilities AG.
Services and prices
The services of Bivio Sports Facilities AG are set out in the service description in the brochure and on the Internet, as well as in electronic media and other written offers. Special requests by the customer require the approval of the management.
With the sale of a ticket, Bivio Sports Facilities AG undertakes to transport the authorised ticket holder in accordance with these General Terms and Conditions. Included is the use of all prepared and marked pistes as well as the hiking and sledging trails. Persons may be excluded from transport if they:
- are drunk or under the influence of narcotics;
- behave inappropriately;
- do not comply with the rules of use and behaviour or the staff's instructions based on them.
Unless otherwise communicated, a lesson at the Snowsports School Bivio Snowsports lasts 55 minutes. If the customer does not turn up at the agreed meeting point at the agreed time, the instructor will wait 20 minutes. No compensation can be claimed for the elapsed time.
If a group is reduced to less than 5 participants, we reserve the right to merge the group or reduce the number of lessons. Multiple changes of teacher may be possible due to the flexible organisation. However, we endeavour to prevent this as far as possible. We do not accept any liability. Lessons take place in all weathers. Personal bookings are not transferable. Unused lessons are forfeited.
The lesson prices can be found in the brochure or on the Internet. The prices are, as a rule, per person. The basic price is quoted in CHF. Conversion into EURO is made on payment at a conversion rate determined by Schneesport Bivio, taking into account the current exchange rate.
Bivio Sports Facilities AG expressly reserves the right to change brochure details, service descriptions and prices in the brochures and on the price lists. Should this be the case, you will be informed by Bivio Snowsports before the contract is concluded.
The course fee does not include the use of the lifts (unless otherwise stated).
We recommend early booking so that we can confirm the desired services.
Access system
Every user of Bivio Sports Facilities AG requires a hands-free card for a deposit of CHF 10. This will be refunded when the card is returned at the ticket offices of Bivio Sports Facilities AG or in the shops and hotels of Bivio. Deliberately damaged or labelled tickets will not be taken back. Unused single tickets for the winter season will not be refunded and expire at the end of the season.
Validity of the tickets
The Bivio Ski Card may only be used by one person. All tickets are personal and non-transferable. Do not carry two Bivio Ski Cards on you, as both cards can be cancelled. Electronic devices and Ski Cards from other mountain railways can make it difficult to pass through the turnstile. Any misuse will result in the withdrawal of the ski pass without compensation and the subsequent payment of the ticket price plus an administration fee of CHF 80.
Lost ski passes will not be replaced. Exceptions: From a 6-day pass (deposit CHF 10.-).
Operating settings
Installations may be closed due to unfavourable weather conditions, operational disruptions, slope closures or lack of snow. In the event of poor weather and/or poor visibility, lifts may be cancelled. This does not give rise to any entitlement to a ticket refund. The customer is not entitled to a ticket refund due to official orders and restrictions (epidemic, pandemic, power shortage, etc.).
Safety in the ski area
For safety reasons, no persons with children in rucksacks or on shoulders will be transported on the ski lifts. Only marked and open pistes will be checked. The last piste check by the SOS and piste service takes place daily at 4.15 pm. Therefore, always ski down to the valley in good time. Search operations and rescue missions after the last piste check or the opening of lifts after closing time are entirely at the expense of those responsible. Rescue operations will be invoiced in accordance with SVS regulations. (These costs can be passed on to the insurance companies.) Outside of lift operating hours, the slopes are closed and are not protected from dangers such as avalanche blasting and snow groomers. There is a danger to life.
Accident in the ski area and rescue service
If a ticket purchaser suffers an accident while using the railway facilities or in the snow sports area of the Bivio sports facilities, he/she can
the Bivio Sports Facilities AG rescue service. The costs of using the Bivio Sports Facilities AG rescue service will be charged by Bivio Sports Facilities AG. Other third-party costs (e.g. REGA, medical appointments) are to be paid directly by the customer. It is the customer's responsibility to assert any claims for reimbursement against their insurance company.
Refund
Only multi-day tickets will be refunded on presentation of a medical certificate (amount of refund according to the regulations, from the date the ski pass is deposited at the ticket office).
Refunds for lessons due to injury or illness are only possible with a doctor's certificate. Only unused days (difference with deduction of a processing fee of one day) will be refunded. Lessons cancelled due to weather conditions (force majeure) will not be refunded.
Payment
We accept cash in CHF and EURO, REKA cheques, as well as Maestro, Postcard, Mastercard, Visa, REKA-Card and American Express.
Payment for the snow sports school is made before the start of the course at the Bivio Snowsports office or in the online shop.
Card payments in the online shop in favour of Bivio Sports Facilities AG are collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland (‘TREKKSOFT’). TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your ticket statement. The domain where you enter and process your payment is owned and operated by TREKKSOFT. For refunds of cancelled bookings, the payment method of the original transaction will always be used.
Cancellation of snow sports lessons
All cancellations and changes must be made via the Schneesport Bivio office. In case of cancellation the following cancellation fees apply:
Up to 14 days before the lesson: 0%
14 days to 48 hours before the lesson: 50%
Cancellations made less than 48 hours before the reservation will be charged at the full rate.
Complaints, liability
Bivio Sports Facilities AG is liable for personal injury and damage to property caused by it or its employees in accordance with the following provisions. To the extent permitted by law, liability is limited to grossly negligent and wilful behaviour. Liability for slight negligence is excluded.
Bivio Sports Facilities AG accepts no liability for damage to property or personal injury in the event of accidents resulting from
- Failure to follow instructions, i.e. disregarding markings and information boards, leaving the
- secured and controlled pistes;
- disregarding instructions and warnings from railway employees or the piste and rescue service;
- disregarding warnings of avalanche hazards;
- negligent or wilful behaviour on lifts and ski slopes;
- practising high-risk sports such as freeriding, snowkiting, paragliding, etc;
- inadequate piste preparation.
Otherwise, the liability of Bivio Sports Facilities AG is essentially based on the guidelines for the duty to ensure safety on snow sports slopes. There is no liability for accidents outside of the secured and marked
marked ski slopes, unless Bivio Sports Facilities AG could be accused of grossly negligent or wilful breach of its duty to ensure safety. Bivio Sports Facilities AG is liable for personal injury or damage to property resulting from non-fulfilment or improper fulfilment of the contract within the framework of these GTC and the applicable national laws. Any liability for theft in the ski area or for damage to property by third parties is excluded.
If the service provided by Bivio Snowsports does not correspond to the contractual agreement or if the customer is not satisfied with the type of instruction and no agreement can be reached on site, the customer must contact the management of Bivio Snowsports directly. Complaints must be addressed to Bivio Snowsports in writing, stating the date, the incident and the persons involved.
Bivio Sports Facilities AG is not liable for accidents during snow sports lessons and competitions. Insurance is the responsibility of the participant.
